§ 1 [General Provisions]

1. The following terms and conditions („Terms and Conditions”) establish the rules of a newsletter service provided by Admind Agency („Newsletter Service”).

2. The provider of The Newsletter Service is Admind Agency sp. z o.o., with its registered office in Kraków, Dworska 1, registered in the Register of Entrepreneurs of the National Court Register kept by the District Court for Kraków-Śródmieście in Kraków, XI Economic Department of the National Court Register under KRS number: 0001006641, NIP (Tax id.): 6793126270, e-mail: office@admind.pl, tel.: _____________ („Admind Agency”).

3. Admind Agency provides electronic services in accordance with the Terms and Conditions and applicable laws.

§ 2 [Newsletter Service]

1. The Newsletter Service is provided to a subscriber who has agreed to receive the materials referred to in section 2 from Admind Agency („Subscriber”).

2. The Newsletter Service consists of providing the Subscriber with informative materials, including materials regarding Admind Agency’s offerings, ebooks and invitations to the participation in webinars („Informative Materials”).

3. Receiving the Informative Materials by the Subscriber requires having access to a properly configured e-mail along with access to the Internet and any up-to-date web browser.

4. The Newsletter Service is provided free of charge.

5. The Informative Materials shall be sent to the e-mail address provided by the Subscriber.

6. The Newsletter Service Agreement shall be concluded upon the Subscriber’s consent to send The Informative Materials.

7. The Newsletter Service shall be provided for an indefinite period of time.

8. The Newsletter Service Agreement may be terminated at any time by the Subscriber’s withdrawal of consent to sending Informative Materials. Immediately upon receiving the notice of termination of the Newsletter Service Agreement, Admind Agency shall discontinue the Newsletter Service, confirming this fact to the Subscriber.

9. The termination statement for the Newsletter Service may be submitted by email to _______________, in paper form to: Admind Agency sp. z o.o., Dworska 1, 30-314 Kraków or by clicking on the „cancel subscription” button available in the e-mail sent with the Informative Material.

10. The provision of unlawful content by the Subscriber using the Newsletter Service is prohibited.

§ 3 [Personal data]

1. Subscribers’ personal data shall be processed by Admind Agency as data controller.

2. The detailed provisions regarding the processing of personal data, including the purpose and scope of processing, are included in the Privacy Policy (available to the Subscribers at the time of registration and to be found on the Admind Agency’s website).

§ 4 [Liability of Admind Agency]

In case of improper performance of the Newsletter Service, Admind Agency shall be liable in accordance with the provisions of generally applicable laws, including those specified in the Civil Code.

§ 5 [Complaint procedure]

1. The Subscriber has the right to file a complaint regarding the electronically provided services referred to in these Terms and Conditions. The complaint may be submitted in particular by e-mail to office@admind.pl or in paper form to: Admind Agency sp. z o.o., Dworska 1, 30-314 Kraków.

2. Admind Agency encourages the Subscriber to indicate precise information regarding the subject of the complaint, including: the Subscriber’s name, mailing address, e-mail address, pointing out the factual circumstances supporting the complaint. Indication of the above data will quicken the processing of the complaint. Indication is only a recommendation and does not affect the effectiveness of the complaint submission.

3. Admind Agency will review the complaint and respond to it no later than 14 days from the date of its receipt. If Admind Agency does not respond to the complaint within the stated period, Admind Agency shall be deemed to have considered the complaint as justified.

§ 6 [Amicable dispute resolution]

1. Admind Agency states that it will endeavour, as far as possible, to resolve amicably any disputes arising between Admind Agency and a Subscriber who is a consumer, due to the use of the Newsletter Service.

2. An ODR platform, established on the basis of Regulation (EU) No 524/2013 of the European Parliament and of the Council of 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC (Regulation on ODR in consumer disputes), is available at https://ec.europa.eu/consumers/odr/main/?event=main.home2.show. The ODR platform provides an access point for consumers and traders to resolve out-of-court disputes covered by the above-mentioned regulation.

3. In the event of a dispute between a consumer and Admind Agency about a complaint submitted by the Subscriber, the Subscriber may use out-of-court complaint and redress procedures. The consumer may, in particular, apply for mediation or the consideration of the case by an arbitration court, or use the assistance of the district (city) consumer ombudsman.

4. Detailed information on the possibility for a Subscriber who is a consumer to use out-of-court ways of dealing with complaints and pursuing claims is available, among others, on the Polish-language websites of the Office of Competition and Consumer Protection at www.uokik.gov.pl, as well as on the websites of Provincial Trade Inspection Inspectorates (e.g. http://wiih.org.pl/index.php).

§ 7 [Amendments of the Terms and Conditions]

1. Admind Agency shall be entitled to amend the Terms and Conditions for reasons such as: change of law, change of collected data or change of provided Informative Materials.

2. The amendment of the Terms and Conditions shall become effective on the date stated by Admind Agency, which in each case shall not be sooner than 7 days from the date the new Terms and Conditions are made available to the Subscriber.

3. Amendments to the Terms and Conditions shall not affect the rights and obligations of the parties arising prior to such amendment.

4. Amendments to the Terms and Conditions shall be binding on the Subscriber if the Subscriber has not terminated the Newsletter Service Agreement within 7 days from the date of notification of the amendments. § 8 [Final provisions]

1. The contents of the Terms and Conditions are available to each Subscriber in the form of a PDF file available on the website of Admind Agency.

2. In the event that any provision of the Terms and Conditions is declared invalid or ineffective, the remaining provisions of the Terms and Conditions shall remain in force and efficiency.

3. Any matters not addressed in these Terms and Conditions shall be governed by generally applicable provisions of Polish law, in particular: Civil Code, Law on Provision of Electronic Services.
